The purpose of this Privacy Policy is to disclose to you what information we may collect, how we may collect it, with whom we may share it, and certain other matters related to such information, including the choices you have regarding our collection of information and our use and disclosure to other parties of information we may have collected from you in connection with the Sled Island Music Inc. (“Sled Island”) website (the "Site"). This Privacy Policy is subject to, and incorporates by this reference, the Terms of Use.

Sled Island is committed to protecting your privacy. We use the information we collect about you to facilitate commercial transactions and to provide you with a more personalized experience. We have created this Privacy Policy statement in order to demonstrate our firm commitment to protecting the privacy of all of our customers and visitors. The following Privacy Statement discloses the information-gathering and dissemination practices and policies of SLED ISLAND.

Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you online. For some services, we either collect and transfer personal information to a service provider you have selected, or you may visit other merchants through links on our site who may collect and use your personal information. We encourage you to ask questions and to be very cautious before you disclose your personal information to others.

  1. Types of information that may be collected

    In order to operate the Site and provide you with information on products and services that may be of interest to you, we may collect "contact information" (i.e., information that could be used to contact you such as full name, postal address, phone number and email address as well as your computer's unique IP address (if any)), "financial information" (i.e., passwords, credit and debit card numbers and bank and other financial institution account numbers) and "demographic information" (e.g., zip code, postal code, hometown, gender, purchase history information, posting and sales information and age as well as IP addresses that are not unique to your computer) from you. Please note that nowhere on the Site do we knowingly collect contact information or financial information from children under the age of 12.

    Specific details may include, but is not limited to the following and may be subject to change: · In the case of contests, promotions, and/or newsletter registrations: We require all users and/or customers wishing to participate in any of our contests, drawings, sweepstakes, promotions, or newsletters to complete a Participant Registration Form. During this registration process we generate and collect certain personally identifiable information.

    • The personally identifiable information that may be collected from our customers in completion of a registration form: Customer's first name, last name, postal code, phone number, age and email address. Winners of contests, drawings, sweepstakes, and/or promotions will be required to provide additional personally identifiable information such as a shipping address and telephone number.
    • In the case of product and/or service purchases: In order to complete the purchase of a product and/or service, an online credit card transaction is required. During this process we generate and collect certain verifiable personally identifiable information.
    • The personally identifiable information that may be collected from our customers in completion of a product and/or service purchase: The verifiable personally identifiable information required includes the customer's first and last name, first and last name of the credit card owner, credit card billing address, credit card number, credit card expiration date, customer's shipping address, phone number, and email address.
    • If a customer sends us personal correspondence, such as emails or letters, we may collect such information into a file specific to you.

  2. How is the information collected

    We use contact information to help us efficiently perform transactions, to deliver the services you have requested, to perform quality assurance, sales analyses and other business analyses, and to contact you in connection with events for which you order, post or sell tickets (including event confirmations, changes and cancellations). In some cases we may use service providers to help us perform some of these tasks, including, but not limited to, processing or fulfilling your orders, or performing customer service, business analyses or quality control, and consequently we may share your contact information with these service providers. In such cases, we often require these service providers to enter into agreements with us regarding the confidential handling of your information. We may also provide your contact information to your credit card issuer or to credit card processors for their purposes. When you make a purchase through the Site, or register with the Site, you will provide us with an email address where we, or these service providers, may contact you for the purposes described in this paragraph.

    We may collect information from you in several different areas on the Site, including but not limited to those described below:

    1. Transaction Information

      If you order any information from our Site, buy any of our products or subscribe for any of the services offered on our Site, we will ask you to complete an order form that will request certain information from you, including financial information such as a credit card number and expiration date and general contact, billing and shipping information. We will use this information to complete the transaction that you have requested, i.e., to deliver the information, products or other services that you order, and to invoice you. Such information is collected and stored through encrypted means for your protection.

    2. Registration

      You may be asked first to complete a registration form and provide personally identifiable information; you may also be asked to choose a user ID and password in order to take advantage of certain features the Site may choose to offer, including, but not limited to, newsletters, contests, forums, or other subscription based services.

    3. Newsletters and Site Emails

      We may offer free newsletters to share information with you about the Site, about us and our affiliates and subsidiaries, or about our business partners and advertisers and sponsors. You may receive a newsletter either by registering for a particular newsletter or in conjunction with a special feature or membership for which you have registered on the Site. You may cancel your free email subscription by following the instructions provided on the Site or, in some instances, in the designated area of certain newsletters or emails.

    4. Contests or Sweepstakes

      We may operate contests and sweepstakes through the Site, which may require registration. Your personally identifiable information may be used to contact you for winner notification, prize delivery confirmation or other related purposes. We may ask your permission to allow us to post publicly some of your information on the Site, such as on a winners page, in the event you win a contest or sweepstakes. Except as required by applicable law, we will not post your information without your permission. In some instances, a third party advertiser or sponsor may operate or host a contest or sweepstakes on the Site, and collect your information. In those cases, where we are not the operator or host of the contest or sweepstakes, we have no control over the information collected and accordingly urge you to review the advertiser's or sponsor's Privacy Policy applicable to the contest or sweepstakes before participating.

    5. Surveys or Voting

      From time-to-time we may request personally identifiable information from you via surveys or voting polls. Participation is voluntary and you will have the opportunity to decide whether or not to disclose information. At times, you may have to register to vote or to take part in a survey.

      To enhance your experience with the Site, Sled Island reserves the right to use "cookies." Cookies are text files we place in your computer's browser to store your preferences. Cookies, by themselves, do not tell us your e-mail address or other personal information unless you choose to provide this information to us by, for example, consenting to be included in our mailing list. However, once you choose to furnish the Site with personal information, this information may be linked to the data stored in the cookie.

      We use cookies to understand site usage and to improve the content and offerings on the Site. For example, we may use cookies to personalize your experience at our Site (e.g., to recognize you by name when you return to our Site), or save your password in passwordprotected areas. We also may use cookies to offer you products, programs, or services.

    7. Web beacons

      "Web beacons" or clear .gifs are small pieces of code placed on a web page to monitor the behaviour and collect data about the visitors viewing a web page. For example, web beacons can be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page. We may use web beacons on this Site from time to time for this and other purposes. If you do not want information collected through the use of cookies, you generally can opt out of providing this information by turning the cookies off in your browser; however, some areas of the Site may not provide you with a personalized experience if you have disabled the use of cookies.

    8. IP Addresses and Click-stream Data

      We may collect IP addresses and/or click-stream data for purposes of system administration and to report aggregate information to our advertisers and sponsors. An IP address is a number that is automatically assigned to your computer whenever you access the Internet. Our computers identify your computer by its IP address. When you request Web pages from the Site, our computers log your IP address. Click-stream data is information collected by our computers when you request Web pages from the Site. Click-stream data may include such information as the page served, the time, the source of the request, the type of browser making the request, the preceding page view and other such non-personal information. When analyzed, this data helps us analyze how visitors arrive at the Site, what type of content is most popular, what type of visitors in the aggregate are interested in particular kinds of content and advertising, and the like.

  3. How we use the information we collect

    We internally use personally identifiable information about our customers to improve our marketing and promotional efforts, to statistically analyze site usage, to improve our content and product offerings and to customize our site's content and layout. We believe these uses allow us to improve our site and provide better service to our customers.

    We may occasionally use a customer's email address and, in rare situations mailing address or phone number, to contact a customer regarding administrative matters or notices.

    We may disclose specific contact information when we determine that such disclosure will be helpful to comply with law, to cooperate with or seek assistance from law enforcement or to protect the interests or safety of Sled Island or other visitors to the Site or users of services or products provided by Sled Island or to take part with others in joint anti-fraud activities. Also, your contact information may be passed on to a third party in the event of a transfer of ownership or assets, or a bankruptcy, of SLED ISLAND.

    We may use your demographic information to perform business analyses or to tailor the Site and communications to your interests. We may share anonymous, aggregated (grouped) demographic information with advertisers and other third parties so that they can tailor their advertisements and communications to the appropriate audience. Any time that we are allowed under this Privacy Policy to share your contact information or financial information, we may also share your demographic information along with it.

    We use your financial information to check your qualifications, to help us efficiently perform sales and other transactions on the Site, to deliver the goods and services you have requested, to enrol you in the discount, rebate and other programs in which you elect to participate and to perform quality assurance. In some cases we may use, and consequently we may provide to service providers, your financial information to help us perform some of these tasks. We may provide your financial information to event providers, primarily for facilitating "will call" ticket pick up, dispute resolution and customer service at the event venue on the date of the event, and may provide your financial information to those merchants who are providing you with the goods, services or reservations you purchase or order, or who are administering the offers or programs you enter through this Site (or you enter through another site after clicking on a link on this Site promoting such an offer or program).

    We may disclose specific financial information when we determine that such disclosure may be helpful to comply with law, to cooperate with or seek assistance from law enforcement to protect the interests or safety of Sled Island or other visitors to the Site or users of services or products provided by Sled Island or to take part with others in joint antifraud activities. Also, your financial information may be passed on to a third party in the event of a transfer of ownership or assets, or a bankruptcy, of SLED ISLAND.

    Sled Island will not be responsible or otherwise liable for any use or disclosure of your financial information by a third party to whom Sled Island is allowed to disclose your financial information under this Privacy Policy.

  4. With whom the information may be shared

    Information we collect may be accessed by a variety of parties, depending upon the project for which the information was originally collected, the terms of that engagement, and the policies into or out of which the consumer has opted. From time to time, we may send you offers from Sled Island, its affiliated properties, and our promotional partners based on the information you have provided us. In addition, we may provide information we collect about you with third party companies regarding promotions, sweepstakes and other opportunities / offers. These third parties are subject to stringent data security and confidentiality requirements. While we believe this disclosure of your information will result in opportunities that may be of interest to you, you have the right to tell us not to give your information to any third party.     Your request must include your name, email address, mailing address and must be signed. (Signature only required for written request sent by regular mail). Please allow six weeks to process your request. After your request has been fulfilled, the only disclosures we will make are those required by law.

    If you are opted out of receiving all promotional emails, then we will not share your contact information with unaffiliated third parties, unless we are otherwise permitted to under this Privacy Policy (for example, we will still be permitted to share your contact information with event providers or merchants but only to the extent permitted above). If you do not opt out of receiving all promotional emails, then we may share your contact information if we believe it makes business sense. These third parties may communicate directly with you about their products and services.

    Sled Island will not be responsible or otherwise liable for any use or disclosure of your contact information by a third party to whom Sled Island is allowed to disclose your contact information under this Privacy Policy.

  5. What choices do I have about Sled Island collecting, using, and sharing my information Your Consent Can Be Express Or Implied

    Consent can be given expressly, or it can be implied. It can be provided directly by you or by your authorized representative.

    Express consent includes any act by an individual to specifically authorize the use of their personal information. This act of consent could be given orally, electronically, or in writing. You will notice that express consent is requested on some of our forms and applications or may be requested verbally by our staff.

    In the case of implied consent, it is consent that can be reasonably inferred from action or inaction on the part of the individual. An example of implied consent is submitting contact information along with your order for tickets for the Sled Island Music Festival. In this case it can be reasonably assumed the customer is providing consent to the use of personal information to fill the order and complete the billing process.

    By providing express or implied consent, you are consenting to the use of your information as outlined in this Privacy Policy, or on the specific application or form where the information was collected. By submitting personal information to SLED ISLAND, you acknowledge and agree that you have consented to the collection, use and disclosure practices set out herein as they relate to your personal information. You may withdraw this consent at any time by contacting Sled Island as set out below. However, by doing so you limit your access and use of web-site and SLED ISLAND's ability to serve you.

    It is possible for you to use much of our site without giving us any personally identifiable information. When you do register with us or give us personally identifiable information, you will have an opportunity at the time we collect your information -- to limit e-mail communications from Sled Island and from our third-party partners. You can request at any time that Sled Island not send future e-mail to you either by unsubscribing from the communication or by contacting us at zak@brokencity.ca. Also, as mentioned above, there are ways to limit the information collected through technology -- though some of our features won't work if you decide to do this.

  6. What security precautions are in place to protect against the loss, misuse, or alteration of your information

    Sled Island employs security technologies and practices to attempt to protect the privacy and confidentiality of your personal information on web-site. Web-site has security measures in place to attempt to prevent the loss, misuse and alteration of personal information provided to SLED ISLAND. Personal information provided to Sled Island in ways other than on web-site is also attempted to be protected by appropriate security safeguards. Sled Island considers personal information provided by you to be private and confidential and accordingly we treat it with care. However, please keep in mind that "perfect security" does not exist on the Internet and/or the World Wide Web.

  7. Chat Rooms, Forums, and Message Boards

    The Site may provide you with the opportunity to post information for display in areas of the site that are accessible to viewing by the general public ("public areas"), including, but not limited to, bulletin boards, chat rooms and user-submitted concert or other event reviews. You are not required to provide any personal information when using these areas but you may choose to do so. If you post personal information online, it will be publicly available and you may receive unsolicited messages from other parties. This Privacy Policy does not apply to any information that you submit for use in public areas. Sled Island cannot ensure the security of any information you choose to make public in a chat room, forum, or message board. Also, we cannot ensure that parties who have access to such publicly available information will respect your privacy. We ask that you do not submit any contact information or financial information for display in public areas, as other people who use the Site will see it. If you submit such information for display in public areas, Sled Island cannot prevent it from being used in a manner that violates the law, your personal privacy or your safety. By submitting such information for display in public areas, you assume the risks and sole liability arising as a result of such information being displayed.

  8. Links to other Websites

    You should be aware that when you are on the Site you could be directed to other sites beyond our control. For example, if you "click" on a banner advertisement, the "click" may take you off the Site onto a different Website. This includes links from advertisers, sponsors and partners that may use the Site's logo as part of a co-branding agreement. These other Websites may send their own cookies to you, independently collect data or solicit personal information and may or may not have their own published privacy policies. If you visit a Website that is linked to our Site, you should consult that site's Privacy Policy before providing any personal information.

  9. Limitation of Liability

    By providing us with any personal information you expressly and unconditionally release and hold harmless Sled Island Music Inc., and its subsidiaries, affiliates, directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your collected personal information. In addition, while Sled Island takes efforts to ensure the proper and appropriate use of Sled Island data provided by Sled Island to third party companies, promotional partners or vendors, Sled Islandis not liable for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your collected personal information by Sled Island or the abovementioned non-Sled Island entities.

  10. Notification of changes and acceptance of the Privacy Policy

    By using this Site, you signify your agreement to the terms of our Privacy Policy. Sled Island may change this policy from time to time. If so, any such changes will be posted on this page, so that Sled Island may keep its users informed of its information collection practices.
